Official Rules

Launch Your Own Network Series/Grand Prize Drawing

NO PURCHASE NECESSARY.  A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

FOR PERSONS WHO ENTER THE LAUNCH YOUR OWN NETWORK SERIES CONTEST, THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD. 

FOR PERSONS WHO ENTER THE GRAND PRIZE DRAWING (SWEEPSTAKES) THROUGH THIS CREATIVE PRESENTATION, THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD. 

1. Introduction:

Launch Your Own Network Series (“Contest”) is sponsored by Pixel Broadcasting, LLC, 255 West 75th Street, Suite PHA, New York, NY 10023.  The Grand Prize Drawing is sponsored by ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069 (“ePrize”).  Pixel Broadcasting, LLC and ePrize are sometimes collectively referred to as “Sponsors.”  The Grand Prize Drawing is offered in conjunction with multiple companies (“Promoters”) through different Web sites (“Creative Presentations”), announcing many different prizes.  One such Promoter is Pixel Broadcasting, LLC.  One (1) winner will be selected in a random drawing from among all eligible entries received through all Creative Presentations.  The prize for which an entrant is eligible depends on the Creative Presentation through which the entrant entered the Grand Prize Drawing.  The Contest and the Grand Prize Drawing are referred to collectively as the “Promotion.” 

ONLY ONE (1) CONTEST GRAND PRIZE FROM AMONG ALL THE LAUNCH YOUR OWN NETWORK SERIES CONTEST ENTRIES WILL BE AWARDED. ONLY FOUR (4) FIRST PRIZES FROM AMONG ALL THE FINALISTS OF THE LAUNCH YOUR OWN NETWORK SERIES CONTEST WILL BE AWARDED.

ONLY ONE (1) SWEEPSTAKES GRAND PRIZE FROM AMONG ALL OF THE CREATIVE PRESENTATIONS WILL BE AWARDED.

2. Timing: 

The Promotion begins March 15, 2008 at 12:00 a.m. Eastern Time (“ET”) and ends June 15, 2008 at 11:59 p.m. ET (“Promotion Period”).  The Promotion contains six (6) phases as outlined in the chart below:

Pixel Broadcasting, LLC's computer is the official time-keeping device for this Promotion.  Various Creative Presentations may be added to the Sweepstakes Grand Prize Drawing throughout the Promotion Period. 

3. Eligibility:

The Promotion is open only to legal residents of the fifty (50) United States who are at least eighteen (18) years of age at the time of entry who did not purchase any equipment to participate in this Promotion.  Void where prohibited.  Employees, officers and directors of Sponsors and Promoters (including Pixel Broadcasting, LLC, and its agencies), any prize contributors, their respective related companies, franchisees and agents, as well as the immediate family (defined as parents, spouse, children, siblings and grandparents) and household members of each such employee, officer and director are not eligible to enter.  All federal, state, and local laws and regulations apply. By participating, entrant agrees to abide by these Official Rules and the decisions of Sponsors, which are final and binding in all respects. 

4. How to Enter: 

a. The Contest: During the Upload Phase, visit www.fliggeebox.com and fill out the registration form, including a valid mailing address.  P.O. Boxes are not permitted.  Then, upload a minimum of one (1), and a maximum of ten (10) episodes (animated or video), each of which is three (3) minutes or shorter, and pitch your online series idea, including a treatment (description of the series) of two hundred fifty (250) to seven hundred fifty (750) words and a description of each episode, fifty (50) to one hundred (100) words (collectively, the "Submission").  By completing the registration and entering your Submission, you agree that your Submission conforms to the Submission Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions. 

Submission Guidelines

  • The episodes must be in .avi, .mov, .mp4, .mpeg, .mpg, .wmv, .flv, or .swf format;
  • The episodes must not exceed 50 Mb in size each;
  • The episodes must not exceed three (3) minutes in length each;
  • The treatment must be between 250 and 750 words in length;
  • The descriptions must be between 50 and 100 words in length each; and
  • The episodes, treatments, or descriptions cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means.

Content Restrictions:

  • The Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • The Submission must not contain brand names or trademarks;
  • The Submission must not contain images or artwork not created by entrant;
  • The Submission must not contain material that is inappropriate, indecent, obscene hateful, tortious, defamatory, slanderous or libelous;
  • The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
  • The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Submission is created.


For all Submissions: All Submissions will become the exclusive property of Sponsor, and none will be acknowledged or returned.  Sponsor shall have the right to edit, adapt and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the entrant, his/her successors or assigns, or any other entity.  ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES ENTRANT’S IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANFERENCE TO SPONSOR OF ANY AND ALL RIGHT, TITLE AND INTEREST IN THE SUBMISSION INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS.  Sponsor is not responsible for lost, late, incomplete, invalid, un-intelligible or misdirected Submissions, which are disqualified.  Limit: Each entrant may enter up to five (5) different Series Submissions during the Upload Phase.

b. The Sweepstakes Grand Prize Drawing: During each View and Vote Phase, visit www.fliggeebox.com and follow the links and instructions to complete and submit the registration, including a valid home address.  P.O. Boxes are not permitted.  You will proceed to a page where you can rate the posted fifteen (15) Submissions on a scale of one (1) to five (5), five (5) being the best.  Each registered user may rate each Submission only one (1) time during each weekly View and Vote Phase.  For each View and Vote Phase during which you rate at least one (1) Submission, you will receive (1) entry into the Sweepstakes Grand Prize Drawing.  Limit: Each participant may receive one (1) Sweepstakes Grand Prize Drawing entry during each View and Vote Phase.  Multiple entrants are not permitted to share the same email address.  Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified.  Use of any automated program to enter will result in disqualification.  Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations or ratings, which will be disqualified.  In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant.  Potential winners may be required to show proof of being the authorized account holder.  The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

You may enter the Sweepstakes Grand Prize Drawing through as many Creative Presentations as you like.

5. Winner Determination:

a. Contest:  The Contest winners will be determined in the process set forth below.  Sponsor's administration and operation of the Contest and selection of potential winners is final and binding in all matters related to the Contest First Prizes and Grand Prize.

i. Judging Phase: During the Judging Phase, qualified judges determined by Sponsor in its sole discretion will select the entrants with the top fifteen (15) Submissions (the “Finalists”) based on the following criteria (“Judging Criteria”):

  • Originality (25%);
  • Series Engagement (25%);
  • Production Quality (25%); and
  • Feasibility of Series (25%).

In the case of a tie, the entrant whose Submission received the highest score in the Feasibility category will be deemed the Finalist. 

ii. View and Vote Phases: During the View and Vote Phases, visitors to the site will be invited to register and rate the Finalist Submissions on a scale of one (1) to five (5), five (5) being the best.  Each registered user may rate each Submission only one (1) time during each View and Vote Phase.  In order to create a total rating, each rating of one (1) will be worth .1, each two (2) will be worth .2, each three (3) will be worth .3, each four (4) will be worth .6 and each five (5) will be worth 1.  After the conclusion of each View and Vote Phase, the Submission with the highest total rating will be the potential First Prize winner for that week.  In the case of a tie, the Finalist Submission that received the highest score in the Series Engagement category during the Judging Phase will be deemed the potential First Prize winner.   If a Finalist has already won a First Prize from a previous View and Vote Phase, the prize will be awarded to the Finalist with the next highest total rating.  Pixel Broadcasting will notify each First Prize winner on or around the Monday following the View and Vote Phase. 

iii. Contest Grand Prize Winner Determination: After the conclusion of the Promotion, qualified judges determined by Sponsor in its sole discretion will re-judge the Finalists, taking into account the results of the View and Vote Phases, and will select the Contest Grand Prize winner from among the Finalist Submissions based on the following criteria (“Judging Criteria”):

  • Public Appeal (20%);
  • Originality (20%);
  • Series Engagement (20%);
  • Production Quality (20%); and
  • Feasibility of Series (20%).

In the case of a tie, the entrant whose Submission received the highest score in the Feasibility of Series category will be deemed the Contest Grand Prize winner.  The Contest Grand Prize winner will be notified on or around June 30, 2008. 

b. Sweepstakes Grand Prize Drawing: Sponsor's administration and operation of the Sweepstakes Grand Prize Drawing and selection of potential winners are final and binding in all matters related to the Sweepstakes Grand Prize Drawing. Sponsor will randomly select one (1) Promoter's Creative Presentation from among all Creative Presentations and Sponsor will then select one (1) potential Sweepstakes Grand Prize winner from among all eligible entries received through the selected Creative Presentation, on or about July 31, 2008. 

6. Verification of Potential Winners:

Potential winners must comply with all terms and conditions of these Official Rules.  Winning is contingent upon fulfilling all requirements.  The potential Sweepstakes Grand Prize winner will be notified by mail or email within ten (10) days of the drawing.  Each potential Sweepstakes Grand Prize and Contest Grand Prize winner (parent/legal guardian if winner is a minor in his/her state of residence) must sign and return to ePrize, within ten (10) days of being notified, an Affidavit of Eligibility, Liability and Publicity Release (“Affidavit”) in order to claim his/her prize.  If a potential winner cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), or prize is returned as undelivered, he/she forfeits the prize.  In the event that the potential Sweepstakes Grand Prize winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all eligible entries received through the selected Creative Presentation.  Only three (3) alternate drawings will be held, after which the Sweepstakes Grand Prize will remain un-awarded.  In the event that a potential Contest Grand Prize or First Prize winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by selecting the next highest rated Submission, in the manner described above.  Only three (3) alternate winners will be determined, after which the applicable prize will remain un-awarded.  Contest Grand Prize and First Prizes will be fulfilled within 8-10 weeks after the conclusion of the Promotion; the Sweepstakes Grand Prize will be fulfilled within 8-10 weeks after the Sweepstakes Grand Prize Drawing.

7. Prizes:

a. Sweepstakes Grand Prize Drawing: ONE (1) SWEEPSTAKES GRAND PRIZE: The prize for which an entrant is eligible depends on the Creative Presentation through which he/she entered.  The Sweepstakes Grand Prize for a winner who entered through this Creative Presentation will be a Dell XPS Laptop with 17" UltraSharp Wide Screen including Microsoft Windows Vista Ultimate, a Blu-ray disc burner, animation and video editing capabilities, 24" external monitor and additional accessories (determined by Sponsor in its sole discretion). Approximate Retail Value ("ARV"): $10,000.  The odds of this Creative Presentation being selected depend on the total number of Creative Presentations.  If this Creative Presentation is selected, the odds of winning depend on the number of entries received through this Creative Presentation. 

b. Launch Your Own Network Series Contest: ONE (1) CONTEST GRAND PRIZE: $10,000 cash and the opportunity to meet (via telephone or in person, at Sponsor's sole discretion) with a Pixel Broadcasting executive to discuss the possibility of developing more episodes under contract.  ARV: $10,000.  FOUR (4) FIRST PRIZES (one (1) per week): $250. ARV: $250.  Limit; One (1) Contest Grand Prize and one (1) First Prize per person. 

For all prizes:  Winners are solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use.  No other substitution, assignment or transfer of prizes permitted, except by Sponsors, who reserve the right to substitute a prize with another prize of greater or equal value if prize cannot be awarded as stated.  Sponsors will withhold and/or report taxes as required by the applicable law of Sponsors’ and/or Promoters’ jurisdiction and winner’s jurisdiction.

8. Publicity: 

Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsors’ use of winner’s name, likeness, Submission(s), voice, opinions, hometown and state for promotional purposes in any media without further payment or consideration.  Contest winners further agree to conduct any and all media interviews related to the Promotion if requested and not disparage the Sponsors during interviews.

9. General Conditions:

Sponsors reserve the right to cancel or modify the Promotion if fraud, technical failures or any other factor beyond their reasonable control impairs the integrity of the Promotion, as determined by Sponsors in their sole discretion.  In such event, Sponsors reserve the right to award any or all of the prizes at random from among the eligible entries received up to the time of the impairment.  Sponsors reserve the right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of this or any other promotion or to be acting in violation of these Official Rules or any other promotion, or in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately damage Sponsors’ or any Promoter’s Web site or undermine the legitimate operation of this Promotion, may be a violation of criminal and civil laws and, should such an attempt be made, Sponsors and Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law.  Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Release:

By receipt of any prize, each winner agrees to release and hold harmless Sponsors, Promoters (including but not limited to Pixel Broadcasting, LLC), their respective related companies, franchisees, and each of their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize.

11. Limitations of Liability:

Sponsors and Promoters (including but not limited to Pixel Broadcasting, LLC), are not responsible for and entrant hereby releases Sponsors and Promoters (including but not limited to Pixel Broadcasting, LLC) from any claims arising from: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the Promotion; (5) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant’s computer, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or from downloading any material from Sponsors’ or Promoters’ Web site(s), regardless of whether the material was prepared by any Sponsor, Promoter, or a third party, and regardless of whether the material is connected to a Sponsor’s or Promoter’s Web site by a hypertext link.  If, for any reason, an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Promotion, provided that, if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, at its discretion, may determine winners through a random drawing from among all eligible entries received up to the date of discontinuance, or in another manner deemed fair and appropriate by Sponsor, for any or all of the prizes offered herein.  No more than the stated number of prizes will be awarded.  In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

12. Disputes:

Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant, Sponsors and Promoters in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

13. Data Collection:

Sponsors and Promoters collect personal information from you when you enter the Promotion.  The information collected is subject to both the ePrize Privacy Policy (http://www.eprize.com/privacy/privacypolicy.html) and the Pixel Broadcasting, LLC's Privacy Policy (http://www.fliggeebox.com/privacy.aspx).

14. Winner List:

Winner List requests will only be accepted after the promotion end date (listed above) and no later than November 30, 2008.  For the Winner List, send an email with subject line: "E-Launch Your Own Network Series, Winner List Request,” to WinListRequests@eprizefulfillment.com
